Terms of Service
Last updated 25 September 2026.
This is a draft. It has not yet been reviewed by a lawyer. It says, in plain words, how we intend the service to work — but it is not final, and it will change before it is.
English only, for now. These terms are published in English and the English version is the authoritative one. Translations will follow. Where a translation and the English disagree, the English governs.
Who provides Aibertus
Aibertus is operated by EXCITING VENTURES ALIMENTOS LTDA, CNPJ 61.514.449/0001-62, Rua James Watt 77, Sala A1, Pavimento Superior, Jardim Edith, São Paulo – SP, 04576-050, Brazil · contact: mail@dirk.it

In this document, we and us mean EXCITING VENTURES ALIMENTOS LTDA. You means the business that has an Aibertus account. Your customers means the people who write to you on the channels you have connected. Aibertus is a business tool; these terms are an agreement between two businesses.
1. What Aibertus does
Aibertus reads the messages your customers send to the channels you connect — Telegram and, where available, Instagram, Messenger and your own WhatsApp Business number — and drafts or sends replies on your behalf, within limits you set. Where available, it can transcribe voice notes and answer with one. Where available, it can propose appointments and payment links for you to approve. It keeps a record of your conversations, your contacts, and the facts you have approved it to state.
It is a tool that works for you. It does not give legal, medical, financial or professional advice, and neither do we. What it says to your customers is said in your name, and you are responsible for it.
2. Your account
- You must be at least 18 years old, and acting for a business. Aibertus is not for children and not for personal use.
- You must give accurate details and keep them up to date.
- You are responsible for everyone you invite into your account, and for keeping sign-in credentials safe. Tell us promptly if you think someone has got in who should not have.
- One account is one business. Do not resell access or share a single account across unrelated businesses without agreeing it with us first.
3. What the assistant is allowed to say
Aibertus is built so that it may state the facts you have approved and nothing else. When it is asked something it has not been told, it says it will check and puts the question in front of you.
That is a guardrail, not a guarantee. Language models can still be wrong, and a fact you approved can become out of date. You are responsible for keeping your approved facts correct, for setting the handover rules that decide when a person takes over, and for what the assistant says under your name. Check the work — especially prices, availability, and anything you are legally obliged to get right.
4. The channels you connect
On Telegram and, where available, Instagram, Messenger and a WhatsApp Business number connected through Meta's official API (directly or through Zernio), the assistant sends replies on your behalf, within the limits you set — because on those channels you have authorised an automated sender and the platform expects one.
- You stay the owner. Connecting a channel authorises us to answer on it. It does not transfer the account, the number, or the audience to us.
- The platform's own rules apply too. Instagram, Messenger and WhatsApp are Meta's products and Telegram is Telegram's; your use of them is also subject to their terms. If a platform suspends or restricts your account, we cannot answer on it, and that is not a failure of this service.
- Templates and windows. WhatsApp only allows a free-form reply within 24 hours of your customer's last message; after that, only a template Meta has approved can be delivered. Aibertus will use the template you have named, if you have named one. Telegram has no such window.
- You can disconnect at any time, from the console.
5. Acceptable use
You agree that you will not use Aibertus to:
- send anything that breaches WhatsApp's Business Messaging Policy or the equivalent rules of any other channel you connect — these are part of these terms, and a serious breach of them is a serious breach of this agreement;
- send a broadcast, campaign or bulk message to anyone who has not opted in. Consent must be given by that person, for messages of that kind, before the first one is sent. Aibertus records where and when each opt-in came from, and honours an opt-out immediately; do not work around either;
- send unlawful, deceptive, harassing, hateful or sexually exploitative content, or content that infringes someone else's rights;
- impersonate another business or person, or disguise the fact that a message comes from you;
- upload malware, probe or attack the service, try to reach another customer's data, or try to make the assistant act outside the limits set for it;
- use the service to build a competing product, or to train a model on it;
- put other people's personal data into the service when you have no lawful basis to hold it.
If you break these rules in a way that puts the service, a platform relationship, or other people at risk, we may suspend the account — immediately if the risk is immediate, otherwise after telling you what is wrong and giving you a fair chance to fix it.
6. Using your own model key
You may supply your own API key for a model provider and have Aibertus use it instead of ours, so that you pay that provider directly. If you do:
- your use of that provider is governed by that provider's terms and privacy policy, between you and them;
- you are responsible for what they charge you, and for keeping the key valid;
- if your key fails, we do not quietly fall back to ours and bill you for it — the assistant tells you instead;
- we store the key encrypted and use it only to make requests for your account.
7. Money
- You are billed per conversation, per month — not per message. One customer writing to you fifteen times in a month is one conversation. Plans, allowances and rates are shown in the console in your own currency; they are not restated here, because here they would go stale.
- Going over does not cut you off. Conversations past your plan's allowance are charged at a fixed per-conversation rate shown next to the plan and added to that month's bill. The assistant does not go quiet because of a limit.
- Nobody is moved to a bigger plan without being asked. We will tell you when a larger plan would cost you less; changing plans is your decision.
- Fees are payable in advance for the period, and are stated exclusive of any taxes that apply where you are.
- Payment is taken by our payment processor. If a payment fails we will tell you and give you a reasonable chance to fix it before restricting the account.
- You can cancel at any time, effective at the end of the period you have paid for. There is no exit fee, and you can export everything on the way out.
8. Your data
Your conversations, contacts and approved facts are yours. We hold them to run the service for you. What we collect, who it is shared with, and how long it is kept is set out in our Privacy Policy, which forms part of these terms.
You can export everything your account holds, as one file, at any time, at no charge. You can erase an individual customer's data from the console. You can ask us to close the account and delete what is left.
We may use aggregate, de-identified statistics about how the service is used to operate and improve it. We do not sell your data, and we do not use the content of your customers' conversations to train models.
9. Availability
We work to keep Aibertus running and to give you reasonable notice of planned maintenance, but we do not promise it will never be unavailable. Parts of the service depend on other companies — Meta, Telegram, model and speech providers, our hosting and payment providers — and an outage at one of them is an outage here. We do not offer a contractual uptime guarantee under these terms.
10. Changes
We may change the service, and we may change these terms. If a change to these terms is more than a correction — if it affects your rights, your obligations or what you pay — we will tell you before it takes effect, by email and in the console, and give you a reasonable period to read it. If you do not accept the change, you may cancel before it takes effect and we will refund the unused part of anything you have paid in advance. Continuing to use the service after the change takes effect means you accept it.
11. Ending the agreement
You can close your account at any time. We can end this agreement on reasonable notice, or immediately if you seriously breach these terms, if we are required to by law, or if a platform we depend on withdraws the ability to serve you.
Closing an account deletes its data immediately and irreversibly: there is no waiting period and nothing we can restore. Download your export first, from Settings › Account in the console, before you close it.
12. Liability
Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law where it applies to you.
Subject to that:
- Aibertus is provided as it is. We do not warrant that the assistant's answers will be accurate, complete or fit for any particular purpose.
- Neither party is liable to the other for loss of profit, loss of business, loss of goodwill, or indirect or consequential loss.
- Our total liability to you, for everything arising out of or connected with this agreement in any twelve-month period, is capped at the fees you paid us in the twelve months before the event that gave rise to the claim.
You are responsible for what you send to your customers through Aibertus, and you will cover us for claims that arise from your breach of section 5.
13. Law and where disputes go
This agreement is governed by the laws of Brazil, and the courts of São Paulo, Brazil have jurisdiction over disputes arising from it.
That does not take away rights you have where you are. If you are established in another country, any consumer protection and data protection rules of that country that apply to you regardless of what a contract says — including, for businesses in the European Union and the United Kingdom, the GDPR — continue to apply, and nothing here is intended to reduce them.
14. The rest
- These terms, together with the Privacy Policy and the plan details shown in your console, are the whole agreement between us about Aibertus.
- If one clause turns out to be unenforceable, the rest stays in force.
- Not enforcing something once does not mean giving it up.
- You may not transfer this agreement without our consent. We may transfer it to a company that takes over this business, on notice to you.
- Notices to us go to legal@aibertus.com. Notices to you go to the email address on the account, and to the console.
